Terms & Conditions

 

These are the terms and conditions for BnBee (“BnBee”, “we”, “us”). Guests (‘you’) are the individual(s) making the booking and staying at the accommodation.

 

1. Booking Process


Bookings must be made online at either:

•              www.BnBee.co.uk

•              www.bnbeecouk.staydirectly.com


Guests are required to verify their identity and meet other due diligence requirements before their booking can be confirmed. This includes steps such as sharing their legal name, Government ID, confirming their identity with a selfie or AI image check, and providing details/proof of their main residential address and other contact details. Guests may also be required to validate their payment method and/or provide a deposit or authorise a card hold/block, which we will be entitled to use if additional charges are incurred pursuant to the terms of the booking.


A booking provides you with a licence to occupy the accommodation for the duration of the booking as holiday/temporary accommodation only, subject to complying with these terms and conditions and the House Rules applicable to the property. Whilst your party will be the only group to use the accommodation during your stay, we reserve the right to enter the accommodation for housekeeping purposes, for maintenance work, for inspections, for emergency purposes, or for any other reasonable requirement (e.g. to safeguard the property from harm or ensure the terms and conditions are met). Accordingly you will not have exclusive possession of the accommodation and have no right to exclude us or our agents/subcontractors from entry into the accommodation where we require it. We will endeavour to ensure you are informed of any entry into the accommodation in advance as far as practicable and entrants will always announce themselves unless exigent circumstances exist. Of course it is our aim to ensure you enjoy your time in the accommodation without interruption as far as possible.


By making a booking, you confirm that all the information you provide is accurate and that all guests maintain a main residence elsewhere for the duration of the stay and that its details will be provided to us for our records. You will have no right to receive postal mail at the accommodation or provide the accommodation as your main address for any reason whatsoever.


An individual guest making a booking for a group of guests remains responsible under these terms and conditions even if they do not stay in the accommodation themselves.



2. Payment Terms


Payment in full is required at the time of booking unless prior agreement has been made directly with BnBee.



3. Cancellation Policy


•              Cancellations made at least 30 days before your arrival date will receive a refund of half the total booking price.

•              Cancellations made within 30 days of arrival, or in case of a no-show, will be charged the full booking price.

•              No refunds will be given for non-arrivals.

•              BnBee reserves the right to cancel a reservation if they have reason to believe that a reservation has been made to conduct illegal and / or immoral activity. Or that illegal or immoral activity will be conducted at the premises during the reservation. In such a case no refund will be offered.

 

 

4. Check-in/Check-out Times

 

•              Check-in: 2:00 pm onwards. Please provide an estimated arrival time to BnBee so the accommodation can be prepared.

•              Check-out: 11:00 am. Unauthorised late check-outs may incur a fee of £30 per hour (rounded up to the next hour) at BnBee's discretion. If the late check-out impacts a subsequent booking, the charge for an additional day may be applied (at the full charge rate without the benefit of any discounts).


Please let us know as soon as possible if you wish to extend your stay. Whilst we will do everything to try to accommodate such requests, this may not be possible particularly if there are pre-existing bookings by others.


 

5. Occupancy Limits

 

Only the number of named guests confirmed on the reservation are permitted in the property unless prior authorisation has been agreed with BnBee. Unauthorised guests/visitors may be charged a fee of up to £50 per person per day, at BnBee's discretion. Guests may be asked to leave if there are unauthorised visitors. We do not allow parties (which are congregations of people which include non-guests) and have sensors in place (measuring decibels and other metrics but not conversations) to prevent inappropriate gatherings which may prove a nuisance to other guests in the building or neighbours.


Individual listings will identify if children are suitable and permitted to be included as guests. All guests must comply with all relevant laws and regulations applicable to their stay. All guests are jointly and severally liable for compliance with these terms and conditions. This means that if there are two or more guests, you are each responsible for complying with the agreement’s obligations together and individually. We are free to seek to enforce these obligations or claim damages of any amount against one or more of you. It will be up to the person we enforce against to seek a contribution from other guest without reference to us.



6. Housekeeping, Damages and Breakage

 

You are responsible for acting as a prudent occupier of the accommodation and must not damage the contents or the accommodation or allow it to be damaged or lost by any acts or omissions which are reckless, negligent or otherwise improper for a prudent occupier. If in doubt about any matter, please refer to the [House Rules], appliance manuals and/or contact us and we will be happy to provide guidance or assist where required. 


You are liable for any loss or damage (excluding fair wear and tear) caused during your stay, and for any loss of rental income resulting from such damage. This applies if the loss or damage is intentional or not, and whether you or any other guest or invitee is responsible. All loss or damage should be reported promptly in case there is something that can be done to mitigate the impact and so that the most cost-effective solution can be found to fixing the issue and ensuring you can enjoy your stay. We retain inventories and other evidence of condition in order to manage damage claims in respect of guests. BnBee reserves the right to charge for administration fees associated with repairs or dealing with the loss or damage. BnBee may charge your credit or debit card used for the booking. If no card was used, you must pay by another means acceptable to BnBee. All additional charges are due on the check-out date unless otherwise stated.


You are responsible or security of the accommodation during your stay. This includes ensuring that doors are locked when you are absent, and windows and closed and taking other reasonable precautions. We are not responsible for any loss or theft of your items during your stay.


You are responsible for following all safety guidance, including fire safety guidance, in the information provided for within the apartment or otherwise provided to guests or which would be prudent to follow. You are responsible for ensuring the members of your group and in particular any children follow such guidance and act reasonably to promote their own safety. [You acknowledge that candles and all forms of naked flame are prohibited in all accommodation. You will not bring in anything dangerous or noxious into the accommodation].


You must not make alterations to the accommodation (e.g. rearranging the layout, or affixing things to the walls due the presence of buried pipes, adhering decorations to walls etc), or otherwise interfere with the building systems (such as electrical installations, gas systems, fire appliances, lighting, ventilation systems, plumbing, or any other fixtures or fittings serving the accommodation).


At the end of each booking, you must:

•              vacate the accommodation and remove all your personal belongings, leaving it free of unwanted items and not in state that would require excessive cleaning over and above the typical change-over clean employed by our housekeeping team or which would necessitate use of specialist equipment or a ‘deep clean’;

•              ensure all appliances, items, manuals, pieces of furniture, soft furnishings etc. remain within the accommodation and returned to their location as at the outset of the stay;

•              return all keys and ensure the accommodation is properly secured when you leave; 


Any personal items or possessions that are left at the accommodation cannot become our responsibility. Whilst we will make reasonable efforts to hold and return items to you if possible, we regret that we cannot safeguard all items in all circumstances and we have the right to dispose of items if unclaimed within 72hours. Reasonable costs (e.g. postage costs) may be applicable for any returns, and are payable before any items are sent. You must not leave hazardous materials in the accommodation.

 

The accommodation is residential in nature and each listing will have its own arrangements for the disposal of waste as outlined in the Welcome Guide e.g. council collection of individual bins, commercial collection of communal bins etc. If stays fall over refuse collection days in certain listings, those listings will explain that Guests agree to cooperate in placing refuse bins relating solely to their accommodation out for collection/returning them afterwards. Oversized or excessive waste going beyond normal residential use should not be left at the accommodation on check-out. If you exceed your allocated refuse bins (taking into account their fill level on check-in), it is your responsibility to dispose of the excess off-site or you may be liable for any third party commercial collection charges. You must not leave any items the common areas or externally or use refuse bins belonging to other dwellings.


Late payment of additional charges:

 

Failure to pay additional charges within 14 days of receiving an invoice will result in a £50 administration fee to cover debt collection costs.



7. Pets


BnBee has a strict No Pets policy. No animals/pets are allowed inside the property at any time. The freeholder/head leaseholder or other superior rights holder in some buildings will also prohibit animals/pets and guests undertake not to put us in breach of our obligations to them. 



8. No Smoking/Vaping Policy


Smoking, vaping or other forms of combustible material consumption use (including water pipe-based devices or similar and whether the materials involved are tobacco or some other substance) is not permitted inside the building. Violations will incur an additional fee of £100 per guest, immediate eviction with no refund, and a £200 fine for tampering with or setting-off fire safety equipment. Smoke or nicotine residue, staining, discolouration or odour may require specialist cleaning at an additional charge.



9. Responsible Use & Noise Policy


Guests are required to behave responsibly, respect the apartment and other guests. Please keep noise to a minimum between 10:00 pm and 7:00 am. This includes avoiding any nuisance or disruption to other guests, using threatening or abusive behaviour towards BnBee staff, or playing music or making any other kind of disturbance.


The accommodation must not be used for any commercial purposes or be used as a place of business. In particular, the accommodation is not permitted to be used for the following:


•              for any commercial photography or videography (and if any such activity occurs in breach of these terms and conditions, the copyright in such materials will vest in us)


•              for any illegal, immoral or obscene purposes, including creating content or live streaming anything which would be of an illegal, immoral or obscene nature, and any activities involving illegal substances. All such activities may be liable to be reported to the authorities, other booking platforms and can lead to a ban on future bookings. 


We reserve the right to use the building information systems, external CCTV and sensors/testing kits to monitor for breaches of these terms and conditions, including for smoking/vaping use, substance abuse, excessive noise, overcrowding and unauthorised/excess occupants. Noise above 75db for a period of 10minutes or more in one incident or spread out over a period of time, as reasonably determined by us, will be sufficient to trigger our concerns under the noise policy. If warnings are not addressed, this may lead to termination of your booking and eviction without refund.


We reserve the right to refuse accommodation to anyone for any reason(s) relating to the safeguarding of the accommodation or protecting our legitimate business interests from your breach or illegal behaviour. These include, but are not limited to, payment or deposit verification failure, being under the influence of alcohol, drugs, or any other intoxicating substances, acting in a disorderly fashion so as to disturb the peace, seeking to use the accommodation for unlawful purposes or in breach of these terms and conditions, damaging or threatening to damage the accommodation, abuse or harm towards any of our employees, agents or contractors or any other residents in the building or neighbours.


Violations of this policy may result in immediate eviction with no refund and responsibility for any additional charges incurred.


10. Complaints and Disputes


If you are dissatisfied with any aspect of your accommodation, please notify BnBee as soon as possible during your stay. This allows BnBee the opportunity to address and resolve the issue. Complaints can be emailed to Dan@BnBee.co.uk.



11. Termination of Licence, Overstays & Evictions

 

BnBee reserves the right to remove or evict guests and anyone they have given access to the property for violating the house rules and conditions outlined above on immediate notice. You acknowledge BnBee’s rights under these terms and conditions and at law to deem you an excluded occupier (within the meaning of section 3A of the Protection from Eviction Act 1977) and/or a trespasser as appropriate in such circumstances. BnBee may utilise an affiliated security team and/or law enforcement for eviction. We reserve the right to remove your belongings and/or change the locks/access codes.

In the event of an eviction, the guest will be liable for an "Eviction Charge" of £200, in addition to any other applicable charges and costs incurred by us during the eviction process including third party security team costs and all losses due to the impact on subsequent bookings and the applicable charge for the period of overstay. No refunds will be offered for any unused nights following an eviction.



12. Liability

 

You shall be responsible for, and shall indemnify and hold harmless us and the property owner against, any loss, damage, or physical injury caused by you or your invitees, and against any claim or demand made by any third party arising from your stay or breach of these terms. This indemnity includes all reasonable costs and expenses (including legal costs on a full indemnity basis) incurred in dealing with such loss, damage, injury, claim, or breach, or in eviction or recovering possession of the accommodation if you fail to vacate when required.


Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence or that of our agents. Subject to this, we are not liable for loss of or damage to your personal belongings, or for injury, loss, or damage arising from matters beyond our reasonable control. We recommend you obtain appropriate travel or other insurance if required.



13. Data Protection

 

We comply with data protection laws, including the UK General Data Protection Regulation (UK GDPR) as part of our provision of the accommodation. We maintain an annual registration with the ICO for data protection purposes and our Privacy Policy from time to time is also available on request. We may need to process personal data from time to time to fulfil our contractual obligations and rights, to meet legal & compliance requirements, to properly manage and safeguard the building, and to protect our other legitimate interests. We are the data controller for such purposes. Whilst you consent to us and our agents, subcontractors and professional advisors collecting, using, storing, processing or sharing personal data (to the extent we do receive or collect it) for such purposes in accordance with our Privacy Policy, you recognise that such collection, use, storage, processing and transfer of personal data is necessary to provide you with the accommodation and to properly manage it, and any future withdrawal of consent will not necessarily restrict us from exercising our rights in respect of such personal data in law.


As part of our management of the accommodation, we may have access to information from various sources including without limitation CCTV, sensors monitoring smoking/vaping and occupancy, temperature/humidity data, fire system logs etc. and you acknowledge and consent to our use of such data to properly perform our management function, to comply with legal or statutory obligations and safety requirements, to protect the legitimate interests of ourselves and other residents in the building, and similar purposes to the extent not prohibited in law. Where such data constitutes personal information relating to individuals, this will be processed in accordance with the data protection provisions in these terms and conditions.



14. General

 

In these terms and conditions: (a) the House Rules and any other document incorporated into these terms and conditions by reference shall have full force and effect as if expressly set out in the body of these terms and conditions, save that in the event of conflict these terms and conditions shall take precedence; (b) reference to a statute or statutory provision is a reference to it as amended, extended, replaced, consolidated or re-enacted from time to time, and include all subordinate legislation made from time to time; (c) reference to writing or written includes e-mail (or other durable digital communication); (d) any words following the words “include”, “includes”, “including”, “in particular”, “e.g.” or any similar words or expressions will be construed without limitation and will not limit the meaning of the words preceding them, (e) references to the singular includes the plural and vice versa, and references to one gender shall include references to the other gender, (f) references to our ‘agents’ refers to anyone appointed by us from time to time, and can include our officers, employees, workmen, contractors, and (g) references to us or you include our or your successors or assigns, and/or their personal representatives.


You have no right to assign, sub-let, or part possession with the accommodation in whole or in part during your stay or otherwise take-in any other person whether on a paid basis or not. 


Any variations to these terms and conditions in respect of any particular booking must be agreed to by us in writing. These terms and conditions may be amended by us for future bookings at any time. Such amendments will take effect as soon as they are updated. We recommend that you check these terms and conditions upon making future bookings. 


The parties do not intend these terms and conditions to be enforceable by any third party, save that our employees, agents, subcontractors and clients (accommodation owners) shall have the benefit of the provisions of clause 12 (Liability).

If any part of these terms and conditions is held to be illegal, invalid or unenforceable, the legality, validity and enforceability of the remainder of these terms and conditions is unaffected.


A delay by us in exercising or failure to exercise a right or remedy under or in connection with this agreement does not constitute a waiver of, or prevent or restrict future exercise of, that or any other right or remedy, nor shall the single or partial exercise of a right or remedy prevent or restrict the further exercise of that or any other right or remedy. A waiver of any right, remedy, breach or default shall only be valid if it is writing and signed by us or our agents and only in the circumstances and for the purpose for which it was given and shall not constitute a waiver of any other right, remedy, breach or default.


Any notice or other communication given to a party under or in connection these terms and conditions shall be in writing, addressed to that party at its address identified in these terms and conditions (in respect of us) or to the main address given by the guest as part of guest verification (in respect of the guest) and shall be delivered personally or by post/commercial courier. A notice or other communication shall be deemed to have been received: if delivered personally, when left at the address; or if delivered by post/commercial courier on the date that is two working days after posting or at the time that the courier’s delivery receipt is signed as appropriate.


We will not be liable for any act, omission or failure to fulfil our obligations under these terms and conditions if such act, omission or failure arises from any cause reasonably beyond our control including acts of terrorism, civil strife, strikes, lockouts, riots, act or threat of war, epidemics (whether declared or not), governmental action superimposed after the date of these terms and conditions, general power outage, severe adverse weather event, storm, flood, fire, earthquakes or other disasters (“force majeure”). If such an event occurs, we will endeavour to inform you as soon as possible and include how we might be able to mitigate the impact on your booking. There may be circumstances arising out of such events which require us to cancel your booking subject to a partial/full refund as appropriate.



15. Governing Law and Jurisdiction


These terms and conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and subject to the exclusive jurisdiction of the English courts. Nothing in this clause shall limit our right to issue proceedings against the Guest in the courts of any country in which the Guest has assets.
